Environmental Impact Report

The proposed RSA project was originally evaluated by the District under the California Environmental Quality Act (CEQA) through preparation and circulation of a Draft, Recirculated Draft, and Final EIR (collectively, 2011 EIR) and related documents. (Those documents are available via the hyperlinks below.) The District, as the lead agency and project sponsor, certified the 2011 EIR and approved the RSA project on May 4, 2011. The District’s actions subsequently were challenged in a lawsuit filed in the Superior Court of California, County of Monterey on June 3, 2011.

In April of 2012, the adequacy of the 2011 EIR was argued at the trial court level and taken under submission by Monterey County Superior Court. Following the Court’s deliberation on the case, the Court found that the environmental analysis for Monterey Peninsula Airport’s runway safety area project did not satisfy the requirements of CEQA. Although the Court upheld many of the challenged portions of the environmental analysis, certain portions required further study.

In October 2012, the District issued the Revised Draft EIR that addressed those areas identified by the Court. On December 19, 2012, the District certified the Project Environmental Impact Report (Project EIR) for the Runway Safety Improvements Project (RSA Project), and concurrently approved the RSA Project (Resolution No. 1590).  The certified Project EIR (SCH #2009071104) for the Runway Safety Improvements Project (RSA Project) consists of the Draft EIR (October 2010), Recirculated Draft EIR (March 2011), Final EIR (May 2011), Revised Draft EIR (October 2012), and the Revised Final EIR (December 2012).

Following the District’s December 19, 2012 action, legal counsel for the District filed a Motion to Discharge (Motion) the Peremptory Writ of Mandate.  On July 3, 2013, the Court filed an unfavorable Intended Decision on District’s Motion.

In compliance with CEQA, the State CEQA Guidelines and the Settlement Agreement (¶6), District staff, with the assistance of Coffman Associates and Kimley-Horn and Associates, Inc., evaluated the environmental ramifications of the proposed modifications to the approved RSA Project.  Based on the results of that evaluation, an Addendum (November 2013) to the previously certified Project EIR has been prepared in accordance with State CEQA Guidelines Section 15164.

The Addendum concludes that any potential environmental impacts associated with the proposed modifications to the approved RSA Project were identified within the scope of the previously certified Project EIR, and that the environmental ramifications associated with the proposed modifications are the same as, comparable to, or less than those identified in the previously certified Project EIR.  Relatedly, none of the triggering parameters calling for preparation of a subsequent or supplemental EIR pursuant to State CEQA Guidelines Section 15162 and 15163 have occurred.

State CEQA Guidelines Section 15164(c) provides that the Addendum does not need to be circulated for public review.  The Addendum, however, was made available to the public on November 6, 2013, with a copy being posted via a hyperlink below.
